These Terms & Conditions apply to all quotations, orders, sales, supplies, and services provided by SM MARINE SERVICE™. Specific terms stated in our Quotation, Proforma Invoice (PI), Sales Contract, Purchase Order confirmation, or other written agreement will apply to the relevant transaction.
SM MARINE SERVICE™ primarily operates as a Business-to-Business (B2B) marine equipment supplier serving ship owners, ship managers, shipyards, marine equipment dealers, trading companies, purchasing companies, and other professional customers worldwide.
We supply marine equipment and spare parts in different conditions, including:
Brand New
New / Unused Surplus
Used
Used & Tested
Reconditioned
Professionally Reconditioned
The condition of the offered product will be communicated to the customer before order confirmation.
For used or reconditioned equipment, normal signs of previous use, age, cosmetic marks, or previous installation may be present. Such cosmetic conditions will not be considered a functional defect when the product has been sold as Used or Reconditioned.
Before confirming an order, customers are encouraged to verify the available manufacturer, model, part number, nameplate, serial number, photographs, specifications, condition, and other technical information.
Additional photographs, videos, or testing information can be provided when available.
The customer is responsible for confirming that the ordered model or part is suitable for the intended system or application unless SM MARINE SERVICE™ has specifically confirmed compatibility in writing.
When equipment is offered with a Working Guarantee, SM MARINE SERVICE™ guarantees that the equipment will be supplied in working condition according to the agreed sales terms.
If a genuine functional problem is identified within the agreed guarantee period, the customer should contact us promptly with photographs, videos, installation information, and relevant test results.
After technical verification, depending on the circumstances and agreed sales terms, SM MARINE SERVICE™ may provide:

Repair
Replacement
Equivalent Replacement
Other Mutually Agreed Solution
Refund, where specifically agreed or appropriate
Our objective is to resolve genuine product problems fairly and maintain long-term relationships with our customers.
Working Guarantee does not normally cover problems resulting from:
Incorrect Installation
Incorrect Wiring or Voltage
Improper Programming or Configuration
Modification or Unauthorized Repair
Physical Damage after Delivery
Water, Fire, Electrical Surge, or External System Damage
Incorrect Operation or Misuse
Installation into an incompatible system
Normal consumable or age-related components unless specifically agreed
Customers should therefore use appropriately qualified personnel for installation and commissioning.
Depending on the customer, order value, destination, and commercial agreement, SM MARINE SERVICE™ may accept:
TT / Bank Transfer
Letter of Credit (LC)
Full Advance Payment
Partial Advance Payment
50% Advance with Balance as Agreed
Approved Credit Terms
Payment conditions will be agreed individually and stated in the applicable quotation, PI, or sales agreement.
For established and trusted customers with satisfactory business history, SM MARINE SERVICE™ may provide special credit facilities.
Depending on internal approval and the transaction, we may dispatch equipment against partial payment, 50% payment, agreed credit terms, or payment after shipment/delivery.
Such facilities are based on mutual trust and previous business relationships and are not automatically available to every customer.
Prices depend on availability, product condition, quantity, market conditions, and delivery requirements.
A quotation remains valid for the period stated in the quotation. If no validity period is stated, price and availability should be reconfirmed before placing the order.
An order is considered confirmed after the agreed Purchase Order, payment, LC, or other required confirmation has been received.
For products specially sourced, purchased, repaired, programmed, modified, or prepared specifically against a confirmed customer order, cancellation or refund may not be possible once procurement or preparation has started.
Any cancellation will therefore be reviewed according to the circumstances of the individual order.
SM MARINE SERVICE™ supplies marine equipment and spare parts worldwide.
Shipment may be arranged by international courier, air freight, sea freight, or other agreed transportation methods.
Shipping charges, Incoterms, insurance, customs responsibilities, and delivery arrangements will be agreed according to the individual order.
As part of our B2B service, SM MARINE SERVICE™ can ship products directly to a buyer's end customer, vessel, ship owner, agent, warehouse, or nominated destination.
Such direct shipment does not create a separate sales relationship between SM MARINE SERVICE™ and the buyer's end customer.
The original B2B buyer remains our commercial customer for that transaction unless otherwise mutually agreed.
Equipment will be reasonably and professionally packed according to its size, weight, sensitivity, and transportation requirements.
Where required, special export packing or wooden cases can be arranged.
Unless otherwise agreed in writing, destination-country customs duty, VAT, import tax, clearance charges, and other local government fees are the buyer's responsibility.
Customers are responsible for confirming applicable import requirements and restrictions at the destination.
We make every reasonable effort to dispatch orders within the agreed timeframe.
However, courier delays, customs procedures, flight schedules, port conditions, weather, carrier disruptions, or other circumstances outside our reasonable control may affect final delivery time.
Customers should inspect the shipment after receipt and confirm that the supplied equipment matches the order.
Any visible shipping damage, incorrect item, missing component, or significant discrepancy should be reported to us promptly with supporting photographs and documentation.
For a working-condition claim, customers may be requested to provide:
Clear photographs and videos
Installation information
Input/output voltage information
Wiring details
Alarm or error information
Test results
Other reasonable technical evidence
This helps us determine whether the issue originates from the supplied equipment or from installation, configuration, wiring, or another part of the vessel's system.
Products should not be returned without prior written authorization from SM MARINE SERVICE™.
Any approved return, repair, replacement, credit, or refund will be handled according to the product condition, agreed guarantee, and circumstances of the transaction.
SM MARINE SERVICE™ believes in long-term B2B relationships based on trust, transparency, product reliability, and fair commercial practice.
If a genuine problem occurs, we encourage customers to communicate with us directly so that both parties can work toward a reasonable and professional solution.
Because marine equipment transactions can differ significantly, any specific terms agreed in writing through a Quotation, Proforma Invoice, Sales Contract, Purchase Order confirmation, or other written agreement will take priority over these general Terms & Conditions for that particular transaction.
